General Terms and Conditions of Warranty

Effective from: 01.03.2025

The warranty covers all products of the Excellent, Axel and Actima brands.

1.       Scope of the warranty

1.1.    The guarantor of Excellent, Axel and Actima brand products is the manufacturer – Excellent S.A.
1.2.    The warranty covers only products sold in the territory of the Republic of Poland and located in that territory at the time of the warranty procedure.
1.3.    The warranty covers the original purchaser of the product and cannot be transferred.
1.4.    The warranty for the product sold does not exclude, limit or suspend the buyer's rights under the warranty specified in the Civil Code.

2.    Warranty declaration

2.1.    The guarantor declares that the products have been approved for general use in construction in accordance with the necessary requirements.
2.2.    The guarantor declares that the products comply with the labelling and guarantees their suitability for use in accordance with their intended purpose if their installation and use comply with the rules and requirements specified in the General Warranty Conditions and Installation Instructions.
2.3.    The guarantor is liable for product defects revealed upon receipt of the goods before installation or during use and resulting from manufacturing errors.
2.4.    The guarantor declares that the defective product will be repaired or replaced free of charge by the manufacturer with the same or another product of similar value,
free from defects.

2.5.    In the event of replacement of the product with a new one or significant repairs to the product, the warranty period shall recommence from the moment of delivery of the defect-free item to the Customer.
2.6.    In the event of minor repairs to the product, the warranty period shall be extended by the time during which the Customer was unable to use the product due to the defect.

2.7. The guarantor shall not be liable for defects resulting from installation, use and maintenance errors that are inconsistent with the manufacturer's instructions, or for mechanical damage to products collected from the seller or already installed. The buyer should check the product upon receipt. Upon receipt of the product, it is assumed that the product has been delivered in a complete and fully functional form. Installation of the product certifies that there are no visible defects or incompleteness of the product prior to installation.
2.8.    The Guarantor shall not be liable for unauthorised modifications or structural changes, or disturbances in the water or electrical installation occurring during the warranty period.
2.9.    The Guarantor declares that the current General Terms and Conditions of Warranty are available to the Customer on the website www.excellent.com.pl and sent by e-mail at the Customer's request.

3.     Warranty period

3.1.     Excellent acrylic bathtubs – the manufacturer provides a 20-year warranty for the colour fastness of the acrylic (does not apply to freestanding bathtubs).
3.2.     Excellent radiators – the manufacturer provides a 12-year warranty for the tightness and powder coating of the radiators.
3.3.     Excellent freestanding bathtubs – the manufacturer provides a 10-year warranty for the colour fastness of the acrylic.
3.4.      Excellent and Axel fittings – the manufacturer provides:
3.4.1.   A 10-year warranty on the durability of the tap body casting.
3.4.2.   A 5-year warranty on the correct operation of the ceramic mixer head.
3.4.3.   A 5-year warranty on the chrome coating.
3.4.4.   2-year warranty on the coating in the following finishes: matt black, matt white, gloss gold, brushed gold, brushed copper, brushed graphite
3.4.5.   2-year warranty on the correct operation of the thermostatic head.
3.4.6.   2-year warranty on other tap components.
3.5.      Actima fittings – the manufacturer provides:
3.5.1.   5-year warranty on the durability of the tap body casting.
3.5.2.   5-year warranty for the correct operation of the ceramic mixer head.
3.5.3.   5-year warranty for the chrome coating.
3.5.4.   2-year warranty for the correct operation of the thermostatic head.
3.5.5.   2-year warranty for other tap components.

3.6.      Excellent bathroom drains – the manufacturer provides a 5-year warranty.
3.7.      Excellent bathroom accessories – the manufacturer provides a 5-year warranty (does not apply to items subject to natural wear and tear during use).
3.8.      Axel and Actima ceramics – the manufacturer provides a 5-year warranty for colour fastness and manufacturing defects (does not apply to toilet seats, which are covered by a 2-year warranty).
3.9.   Excellent and Axel shower enclosures and screens – the manufacturer provides a 5-year warranty (does not apply to elements subject to natural wear and tear during use, such as seals and Clean Control and DSG coatings).
3.10.  Actima shower enclosures and screens – the manufacturer provides a 2 + 3-year warranty, understood as a 2-year warranty and 3 years of free replacement parts. The customer only covers the costs of the service, which can be ordered optionally (does not apply to elements subject to natural wear and tear during use, such as seals and Clean Control and DSG coatings).
3.11.     Hydromassage – the manufacturer provides a 2 + 3 year warranty, understood as a 2-year warranty and a further 3 years of warranty on water pumps and air turbines (does not apply to products installed for display purposes).
3.12.    Excellent bathroom furniture – the manufacturer provides a 3-year warranty (applies to technological defects such as discolouration, surface flaking, delamination or deformation).
3.13.    Excellent furniture fittings – the manufacturer provides a 5-year warranty.

3.14. Excellent bathroom mirrors – the manufacturer provides a 3-year warranty for mirrors with LED lighting and a 2-year warranty for framed mirrors without lighting.
3.15. Excellent electric heaters – the manufacturer provides a 2-year warranty.

3.16.     Excellent radiator valves – the manufacturer provides a 3-year warranty.
3.17.      Shiro concealed toilet frames – the manufacturer provides a 10-year warranty (applies to: frame, cistern and concealed mechanism).   

3.18.    Flaro concealed toilet frames – the manufacturer provides a 10-year warranty (applies to: frame, cistern) and a 5-year warranty (button plate mechanisms). Other components are covered by a 3-year warranty.
3.19.    Shower trays – the manufacturer provides
3.19.1.  Arda shower trays – 5-year warranty
3.19.2. Lavano shower trays – 5-year warranty
3.19.3. Forma and Sense shower trays – 3-year warranty
3.19.4. Zero shower trays – 20-year warranty on the coating
3.20. Other products and spare parts – the manufacturer provides a 2-year warranty.
3.21 Warranty conditions for Dakota 1.0/2.0/2.1 washlet toilets:

  • Electronic parts, seats and hinges – 2-year warranty
  • Ceramics – 5-year warranty

4. Warranty terms and conditions

4.1. Warranty claims shall be submitted by the buyer entitled under the purchase document.
4.2. The buyer shall report any defects immediately after their discovery, especially if there is a possibility of damage.

4.3.      The guarantor shall respond to the warranty claim within 14 days of receipt of the claim and shall endeavour to remedy the defect efficiently and quickly if it considers the claim to be justified.
4.4.      The warranty period specified in the section "Warranty period " always begins on the date of purchase confirmed by the purchase document.
4.5.      The Guarantor shall decide on the manner of handling the complaint. If the complaint is accepted, the Guarantor undertakes to repair the defective product free of charge or replace it with a defect-free product within a period agreed with the Buyer.
4.6.      The Buyer shall deliver or send the defective product, properly secured against damage during transport.
4.7.      The Guarantor shall not reimburse any costs not agreed with the Guarantor and incurred by the buyer, in particular the costs of dismantling, delivery, labour, materials and reinstallation.
4.8.      When replacing a product or its components, all replaced parts become the property of the Guarantor.

4.9.      In the case of a battery body warranty, the main part of the device is defined as a single casting on which the other components are based.
4.10.    The Guarantor's liability for the removal of product defects shall not exceed the purchase value of the goods.
4.11.    The Guarantor's liability in the case of products or their components, the replacement of which does not require professional knowledge or specialised tools, shall be fulfilled without the involvement of a specialised installer.
In such cases, the specified products or components will be sent free of charge to the Customer's address (applies to: shower heads, shower hoses, tap handles, toilet seats, toilet seat hinges, bath plugs, etc.).
4.12. Before submitting a complaint, the Purchaser should check whether the defect is not due to improper installation, storage, use or maintenance of the product.
4.13. The complainant should make the goods subject to complaint available to the Guarantor's representative for inspection on an agreed date.

5.    Exclusions from the Guarantor's liability under the guarantee

5.1.      In the case of defects resulting from random events and natural disasters.
5.2.     In the case of insignificant defects, i.e. those that remain invisible after the product has been installed and do not affect its utility value.
5.3.     In the case of natural wear and tear of the product during use, e.g. replacement of seals, replacement of aerators,
lubrication of guide rollers, etc.
5.4.     In the case of purchasing a substandard product at a reduced price.
5.5.     In the case of products installed in public places and used for purposes other than individual use.
5.6.     In the case of defects resulting from installation that is not in accordance with the instructions and good building practice, and not in accordance with the intended use, including the use of inappropriate equipment or materials.
5.7.     In the case of mechanical damage caused by the user or third parties.
5.8.     In the case of damage and defects arising during transport, handling and as a result of improper storage.

5.9.     In the event of damage to the surface for reasons beyond the manufacturer's control (in particular, failure to follow the product maintenance instructions by using inappropriate cleaning agents, powder or agents containing acid, solvents, chlorine, strong alkalis and detergents, etc.).
5.10.    In the event of defects caused by poor water quality and limescale deposits, including damage to strainers, aerators, switches or
mixer heads.
5.11.    In the event of defects caused by improper protection of the product during construction work.

The advertised products must be clean and in good hygienic and sanitary condition.
